Capturely Terms & Conditions

Delivery
We will deliver your virtually or remotely taken photos to you within one business day of the date of your Event. Delivery of your Content will come directly to the email address you provided to us during your registration, either attached to an email from us or within a link in an email provided by us to you. If you do not receive an email from by one business day from the date of your Event, please email us at hello@capturely.com.

Rescheduling
You may reschedule Services without penalty up to the time of your session. If you attempt to reschedule or cancel an Event after the time of your session, you forfeit your payment.

Opt in for communication
By providing Capturely your email address you consent to Capturely emailing you regarding your appointment, delivery of your photos and matters related to your session with Capturely. You may opt-out of email by replying to any email with “unsubscribe” or by clicking the unsubscribe link.

By providing Capturely your telephone number and checking the box below you OPT-IN to text messages from Capturely regarding your session. Capturely will only send you texts shortly before and directly after your session, to answer any questions you may have, or to inform you of any issues with your upcoming session. You may OPT-OUT of text messaging from Capturely by replying “STOP” to any text message sent.

Privacy Policy
Capturely does not sell, rent or lease its customer’s data (including email and mobile information) to third parties.
Capturely may share data with trusted partners to help perform statistical analysis, send you email or postal mail, or provide customer support. All such third parties are prohibited from using your personal information except to provide these Services to Capturely, and they are required to maintain the confidentiality of your information.
Capturely may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Capturely or the Site; (b) protect and defend the rights or property of Capturely; and/or (c) act under exigent circumstances to protect the personal safety of users of Capturely, or the public.


Release
If you are an entity or individual being photographed or videotaped you agree to the following:
You authorize Capturely Inc. to photograph, record, and film you on behalf of yourself or the person who purchased your session. You release us from any and all claims arising from the creation or use of these materials.

Capturely does not sell, rent, lease, or release its customer’s name, image, likeness, voice, or recorded materials to third parties unless required by law to do so.


Third party apps or services

We may utilize the services of third party applications or services in providing your virtual or remote Services. We are not responsible for the content or security of any third party applications used in a virtual or remote Event.

Content Ownership, Copyright, and Usage
All Content created by us, or any of our employees, independent contractors, agents, or affiliates, is our sole and exclusive property. We hereby grant you an unlimited license to use any Content transmitted to you for its intended legal business use (uses specifically included herein are Client’s posting of images on its social media, advertising, brochures, presentations, internal communication and websites, as needed, in conformance with all local, state and federal laws, rules and regulations).

The Content is provided to the maximum extent permissible by law “as-is” with no express or implied warranties, including, but not limited to, warranties of merchantability or fitness for a particular purpose. We do not warrant or represent that the Content will meet your needs or that the Content will be free of errors.

You may modify, retouch, combine, crop, annotate, or otherwise edit and create derivative works from the Content. Our Content contained within your derivative works remains our copyrighted material, and the terms and restrictions within this license also apply to those derivative works.
