We will endeavor to deliver your Final Images, as defined herein, to you within one business day of the date of your session. From time to time, circumstances out of our control may delay the delivery by a day. Delivery of your Final Images will come directly to the email address and mobile phone number you provided to us during your registration.

If you do not receive an email or delivery text in a timely manner from your initial session, please email us at hello@capturely.com for assistance.

You may reschedule your session, without penalty, up to the time of your session. If you attempt to reschedule or cancel your session after the beginning time of your session, you forfeit your payment or credit and Capturely will not refund your payment.

By providing Capturely with your email address you consent to Capturely emailing you regarding your session, appointment, delivery of your Final Images, and other matters related to your session with Capturely. You may opt out of email by replying to any email with “unsubscribe” or by clicking the unsubscribe link. If you opt out of email prior to the delivery of your Final Images, it may significantly delay delivery.

By providing Capturely with your telephone number and checking the box below you OPT-IN to text messages from Capturely regarding your session. Capturely will only send you texts shortly before and directly after your session, in response to a message from you, to answer any questions you may have, or to inform you of any issues with your upcoming session. You may OPT-OUT of text messaging from Capturely by replying “STOP” to any text message sent. Message and Data rates may apply.

Capturely does not sell, rent, or lease its customer’s data (including email and mobile information) to third parties. Capturely may use your data for training and quality assurance. Capturely may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to:

• Conform to the edicts of the law or comply with legal process served on Capturely or the Site.
• Protect and defend the rights or property of Capturely.
• Act under exigent circumstances to protect the personal safety of users of Capturely, or the public.

You authorize Capturely Inc. to photograph, record, and film you for purposes of utilizing our Services. You release us from all claims arising from the creation of or use of these services or the images obtained.

We may utilize the services of third-party applications or services in providing your virtual or remote Services. We are not responsible for the content or security of any third-party applications used in a virtual or remote session.

All images or recordings created by us, or any of our employees, independent contractors, agents, or affiliates, are our sole and exclusive property. We hereby grant you an unlimited license to use any Final Images transmitted to you for their intended legal business use (uses specifically included herein are posting of images on your social media, advertising, brochures, presentations, internal communication, and websites, as needed, in conformance with all local, state, and federal laws, rules, and regulations). You may modify, retouch, combine, crop, annotate, or otherwise edit and create derivative works from the Final Images. “Final Image” means the delivered, flattened, and rasterized image(s).

The services, including the Final Images, are provided to the maximum extent permissible by law “as-is” with no express or implied warranties, including, but not limited to, warranties of merchantability or fitness for a particular purpose. We do not guarantee or represent that the services or Final Images will meet your needs or be free of errors.
